Rosaiah moves HC against ACB Court’s summons
Former chief minister K Rosaiah filed a petition in the High Court here on Tuesday seeking quashing of the summons issued by the ACB Court asking him to appear before it on August 2 in connection with the Ameerpet land allotment case.
Rosaiah, now governor of Tamil Nadu, said in his petition that the ACB court’s orders were in violation of Article 361 of the Constitution. It was against the Constitution to issue summons to a state governor.
The ACB court issued summons to Rosaiah on June 18 to appear in the court on August 2 as he was an accused under Section 409 (criminal breach of trust) of IPC and several sections under the Prevention of Corruption Act.
He was summoned on a petition filed by T Sri Ranga Rao, counsel for Mohan Lal, that the authorities handed over a land measuring over nine acres worth about Rs 500 crore at Ameerpet to GA Naidu and others in an unlawful manner.
