Disqualification of Lalu and Jagdish Recommended

The Attorney General G.E.Vahanvati recommended immediate disqualification of convicted MPs Lalu Prasad Yadav and Jagdish Sharma.  He writes to Loksabha Secretariat that a notification should be issued to that effect from the Loksabha immediately.

He says that the moment an elected representative of the people for the Parliament or an Assembly is convicted in a court they are automatically disqualified to hold the office and notifications should be issued by the relevant House without any delay.

He said the same thing previously but the Loksabha asked him for the procedure to be followed.  Now he made it clear that the issuance of notifications declaring the seats vacant is necessary.
The Attorney General also clarifies further, “The question of conviction and sentence being stayed by a higher court while hearing an appeal is not relevant at this juncture. It can be addressed separately as and when that stage arises, at the moment immediate disqualification is the law and it can t be postponed for any reason,”

Vahanvati warns that a delay in giving notifications that those seats are vacant will amount to the non-compliance of Supreme Court’s order on it.

Rashtriya Janata Dal Chief Lalu Prasad Yadav and Janata Dal (U) leader Jagdish Sharma were convicted in fodder scam.  Lalu Prasad is awarded a jail sentence of 5 years and Jagdish Sharma got 4 years Jail sentence in fodder scam cases.  As per the Supreme Court’s order, a jail sentence of two years or above in case of MPs or MLAs attracts disqualification.
