BJP leaders are giving a representation to the President Pranab Mukherjee not to approve the ordinance by which Congress party is backing up the convicts to contest in the elections contrary to the Supreme Court’s rule disqualifying the convicted persons and persons in the jail from contesting in general elections.

Supreme Court questions if a person in jail cannot franchise his vote, how can a person in jail ask for a vote? Not only for contesting but the MLAs and MPs will be disqualified if they are convicted in a criminal case with a jail sentence for two years or more.

But the Government promulgated an ordinance by which the Supreme Court rule is superseded.  First, the Government wanted to pass Bill in Parliament but after failing there it passed an ordinance.

BJP senior leader Sushma Swaraj says “Union Cabinet has approved Ordinance on convicted MPs. We are opposed to this. We request the President not to sign this Ordinance”.

As the ordnance will come into force after the President approves it, the BJP representatives are requesting the President not do it as it is unconstitutional.
